Terms of use and listing agreement

1. What BookWV is

BookWV is a directory of lodging accommodations located in West Virginia.

BookWV publishes information about places to stay and provides links that allow travelers to visit the websites or booking systems operated by property owners, managers, or other lodging providers.

BookWV is not:

• A travel agency.
• A booking platform.
• A payment processor for lodging reservations.
• A property manager.
• An owner or operator of the properties listed on the site.

Unless specifically stated otherwise, BookWV does not participate in or receive a commission from reservations made through listing links.

2. BookWV is not a party to your reservation

Any reservation or lodging transaction is between the traveler and the owner, manager, or operator of the property.

BookWV is not a party to that transaction and does not act as an agent for either the traveler or the property.

BookWV does not:

• Hold or guarantee reservations.
• Confirm availability.
• Accept lodging payments or deposits.
• Change or cancel reservations.
• Determine a property’s cancellation or refund policy.
• Issue lodging refunds.

Questions or disputes involving a reservation, payment, cancellation, refund, property condition, or stay must be addressed directly with the property or lodging operator.

Travelers are encouraged to notify BookWV of significant concerns regarding a listed property. BookWV may review complaints and may suspend or remove listings where there is a pattern of credible complaints, inaccurate information, or other violations of these Terms.

3. Listing information

Property descriptions, photographs, amenities, policies, rates, booking links, and other listing information are generally provided by the property’s owner or operator.

BookWV reviews listings before publication but does not independently inspect properties or verify every statement made in a listing.

Any rate displayed on BookWV is generally a starting or representative rate supplied by the property. Unless expressly stated otherwise:

• It is not a quote for a specific stay.
• It does not guarantee availability.
• It may vary based on dates, occupancy, season, or other factors.
• It may not include taxes, cleaning fees, resort fees, or other charges imposed by the property.

The property’s own website, booking system, or reservation agreement controls the final price, availability, and terms of a reservation.

4. Listing fees and subscription terms

BookWV listings are offered for a flat subscription fee. Pricing may vary based on the type, size, or number of properties being listed and is shown on the BookWV pricing page.

Listing fees pay for the right to publish and maintain a listing on BookWV during the applicable subscription term. They are not commissions on bookings.

BookWV does not guarantee:

• Any number of bookings.
• Any number of inquiries.
• Any particular level of website traffic.
• Any search-engine ranking.
• Any position within BookWV search results.
• Any financial or business result.

Unless otherwise stated at checkout, a listing is billed monthly and renews automatically each month until it is canceled.

Payment is processed through Stripe. BookWV does not store complete payment card numbers.

BookWV may offer promotional pricing from time to time.

Automatic renewal

Listings are subscriptions and renew automatically. Unless the listing is canceled before the end of the current billing period, the payment method on file is charged again at the start of the next period, at the rate then in effect for the applicable plan.

A listing may be canceled at any time from the billing page of the BookWV account that purchased it, or by contacting BookWV. Cancellation stops future charges; it does not refund a period already paid for.

Paying a year in advance

A listing may instead be purchased for twelve months in advance at a discount to twelve monthly payments. The discount in effect is shown on the pricing page at the time of purchase. A listing paid annually also renews automatically, once a year, until it is canceled.

5. Listing review, rejection, and refunds

Every new listing is reviewed before publication.

BookWV may request corrections or reject a listing when, for example:

• The property is not located in West Virginia.
• The booking link is broken or does not lead to the applicable property or business.
• Photographs do not accurately represent the property.
• The person submitting the listing does not appear authorized to list it.
• Content infringes another person’s intellectual property.
• Information is misleading or materially inaccurate.
• Content is discriminatory, unlawful, fraudulent, or otherwise inappropriate for BookWV.
• The listing does not meet BookWV’s then-current listing requirements.

If corrections are needed, BookWV will generally identify the issue and allow the owner or operator to update and resubmit the listing.

If BookWV permanently rejects a new listing before publication for a reason that cannot reasonably be corrected, the applicable listing fee will be refunded.

6. Suspension and removal

BookWV may suspend, unpublish, or remove a listing when reasonably necessary to protect travelers, maintain the quality of the directory, or enforce these Terms.

Reasons may include:

• A booking link that no longer works.
• A property that has been sold, closed, or is no longer available for lodging.
• Materially inaccurate or outdated information that is not corrected.
• Misleading photographs or descriptions.
• A credible pattern of traveler complaints.
• Fraudulent or unlawful activity.
• Violation of these Terms.

When practical, BookWV will contact the listing owner and provide an opportunity to correct the issue before permanently removing a listing.

BookWV may remove or suspend a listing immediately when it reasonably believes continued publication could cause harm, facilitate fraud, violate the law, or materially mislead travelers.

If a listing is removed because of a violation that the owner or operator does not correct, BookWV is not required to refund the listing fee.

7. Renewal and expiration

A listing renews automatically at the end of each billing period - monthly, or annually where twelve months were purchased in advance - unless it is canceled before that period ends.

BookWV may send renewal reminders before a listing is charged or expires.

A canceled listing remains published through the end of the period already paid for.

If a listing is not renewed, BookWV may unpublish it at the end of its paid term.

BookWV may retain listing information for approximately 90 days after expiration so that a prompt renewal can restore the existing listing rather than requiring the property to be entered again.

After that period, BookWV may permanently delete or archive the listing information in accordance with its Privacy Policy.

8. Owner and operator responsibilities

By submitting or maintaining a listing, you represent and agree that:

• You own, operate, manage, or are otherwise authorized to advertise the property.
• You have the right to provide and use the photographs, descriptions, logos, trademarks, and other content you submit.
• The information in your listing is accurate and not misleading.
• You will update the listing when material information changes.
• The property will comply with applicable laws, licenses, permits, registrations, lodging taxes, safety requirements, and other legal obligations.
• You are responsible for your own pricing, policies, reservations, payments, taxes, guest communications, and operations.
• You will honor valid reservations according to the terms you provide to the traveler, subject to your own reservation agreement and applicable law.
• You will not use BookWV to engage in unlawful, discriminatory, fraudulent, or deceptive conduct.

9. License to listing content

You retain ownership of the content you submit to BookWV.

By submitting listing content, you grant Appalachian Heritage Media and BookWV a non-exclusive, royalty-free license to use, reproduce, resize, format, display, and distribute that content as reasonably necessary to:

• Publish and promote your listing on BookWV.
• Display BookWV search and category pages.
• Promote BookWV and properties listed on it.
• Display previews or links to BookWV pages through search engines, social media, email, and other promotional channels.

This license applies while your listing is active and for a reasonable period afterward as necessary to remove previously published promotional materials, cached pages, or archived content.

You represent that you have the rights necessary to grant this license.

10. Acceptable use

You may use BookWV to research accommodations, compare properties, save listings, contact properties, and follow booking links.

You may not:

• Scrape, harvest, or systematically collect BookWV listings without permission.
• Copy or republish substantial portions of the BookWV directory.
• Resell BookWV data or listing content.
• Use bots or automated systems to access the site in a manner that interferes with normal operation.
• Attempt to bypass security or access restrictions.
• Submit false or fraudulent inquiries.
• Use inquiry or contact forms to send unsolicited advertising or marketing.
• Impersonate another person or business.
• Use BookWV for unlawful purposes.

BookWV may restrict or block access where it reasonably believes these Terms are being violated.

11. Intellectual property

The BookWV name, branding, website design, original written content, database structure, and other materials created by Appalachian Heritage Media are owned by Appalachian Heritage Media or used with permission.

Property owners retain ownership of the listing materials they submit, subject to the license described above.

Nothing in these Terms gives a user the right to copy, reproduce, resell, or commercially exploit BookWV content except as expressly permitted.

12. Website availability

BookWV may change, update, suspend, or discontinue features of the site from time to time.

We do not guarantee that the website, any specific listing, or any feature will be continuously available, error-free, or uninterrupted.

BookWV may also modify how listings are displayed, categorized, filtered, or ranked as the site evolves.

13. Disclaimer and limitation of liability

BookWV provides its directory and website on an “as is” and “as available” basis.

To the fullest extent permitted by law, Appalachian Heritage Media and BookWV are not responsible for losses, injuries, damages, disputes, or claims arising from:

• A property or lodging stay.
• The acts or omissions of a property owner, operator, traveler, or other third party.
• A reservation, cancellation, refund, or payment dispute.
• Inaccurate information supplied by a property owner or operator.
• The condition, safety, legality, accessibility, or suitability of a listed property.
• The temporary unavailability of BookWV.
• A third-party website or booking system reached through BookWV.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

To the extent liability cannot lawfully be excluded, Appalachian Heritage Media’s total liability arising from a paid BookWV listing will not exceed the amount the claimant paid directly to BookWV during the 12 months immediately preceding the event giving rise to the claim.

14. Indemnification by listing owners

To the extent permitted by law, a person or business that submits a listing agrees to be responsible for claims, losses, or expenses arising from:

• The operation of the listed property.
• Content submitted to BookWV.
• An allegation that submitted content infringes another person’s rights.
• A violation of these Terms.
• A violation of applicable law.

This provision does not require an owner or operator to be responsible for claims caused solely by BookWV’s own unlawful conduct.

15. Changes to these Terms

BookWV may update these Terms as the website, services, or applicable laws change.

The date at the top of this page will identify the latest version.

If a material change affects the terms of an active paid listing, BookWV may notify the applicable account holder by email before the change takes effect.

Unless required by law or agreed otherwise, changes to paid listing terms will generally apply beginning with the next renewal period rather than changing the commercial terms of a period that has already been paid for.

16. Governing law

These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles.

Any dispute arising from these Terms or use of BookWV will be subject to the jurisdiction of the appropriate state or federal courts located in West Virginia, except where applicable law requires otherwise.
